Fajarasia.co – The case of alleged corruption of regional assets in the form of land on Veteran Street, Fatululi Village, Oebobo District, Kupang City, has become increasingly unclear since the East Nusa Tenggara High Prosecutor’s Office (Kejati NTT), led by Hutama Wisnu, S. H, M. H.
Previously, the alleged corruption case was just waiting for the results of the calculation of state losses (PKN) from the experts. However, until now the results of the PKN by experts have not been announced by the NTT Prosecutor’s Office.
In the alleged corruption case, a number of witnesses have been examined by the Special Crime Investigation Team (Tipidsus) of the NTT Prosecutor’s Office, including a member of the NTT DPRD, Jonas Salean who is also the former Mayor of Kupang.
Seeing the results of the long PKN, a criminal law expert at the Widya Mandira Catholic University (Unwira) Kupang, Mikael Feka spoke up.
Mikael Feka, who was asked for a response regarding the slow completion of the case, said on Monday (23/05/2022) that there were three things that influenced the slow handling of the case.
According to him, if until now the PKN results from experts have not been pocketed by the NTT Prosecutor’s Office, there are three possibilities, including experts while calculating state financial losses if the prosecutor has asked experts to do the calculations.
Another possibility, continued this criminal expert, is that the prosecutor at the NTT Prosecutor’s Office is not proactive in coordinating with experts in conducting PKN. And, another possibility should be suspected that the prosecutor at the NTT Prosecutor’s Office did not ask experts for PKN to be carried out.
“If until now there is no PKN result, then there are only three possibilities. First, the expert temporarily calculates if the prosecutor has submitted a request. Second, the prosecutor is not proactive with the expert and third, it could also not be submitted to an expert to calculate PKN. This possibility can only be answered by the NTT Prosecutor’s Office,” said Mikael who is also a lecturer at Unwira Kupang.
Still according to Mikael, in this case it is clear that the NTT Prosecutor’s Office is just waiting for the Calculation of State Losses (PKN). So the question is whether PKN already exists? If it has been pocketed, how much is the value of the loss and what are the follow-up actions of the NTT Prosecutor’s Office?
He said, if it has not been obtained, then what should the investigators of the Tipidsus Kejati NTT do to obtain the results of the PKN.
Mikael emphasized that for all the obstacles that occurred in this case, it is obligatory for the Head of the East Nusa Tenggara Head Office, Hutama Wisnu, S. H, M. H, to be responsible for completing the case so that it has legal certainty.
“The management of the handling of investigations must be more professional, proportional and independent. Investigations are the front line in law enforcement so I ask investigators to seriously handle the cases they are handling. Related to the management of corruption investigations at the NTT Prosecutor’s Office, the NTT Kajati, Hutama Wisnu, is responsible. Therefore, I ask the NTT Attorney General’s Office to pay extra attention to corruption cases that are currently being handled by the NTT Attorney General’s Office,” he said.
The Head of Penkum and Public Relations of the NTT Prosecutor’s Office, Abdul Hakim, S. H, who was previously confirmed, confirmed that the case had an investigation status (Dik), because an unlawful act was found. So, currently the investigators of the Tipidsus Prosecutor’s Office in NTT only need to determine who deserves and deserves to be made a suspect.
However, Abdul continued, prior to the determination of the suspect, the investigators from the Tipidsus Prosecutor’s Office in NTT will hold an expose before the Kajati of NTT, to determine who is worthy and deserves to be named a suspect.
Abdul added that currently the investigation team for the Tipidsus Prosecutor’s Office in NTT is just waiting for the results of the calculation of state losses from the experts. If the results of the PKN have been pocketed, the suspect will immediately be identified by the Tipidsus investigator at the NTT Prosecutor’s Office.
“We just have to wait for the results of the PKN, if there is one, then the NTT Prosecutor’s Office will expose and determine the suspect,” Abdul added.
According to Abdul, in this case, the East Nusa Tenggara Special Prosecutor’s Tipidsus investigation team has examined a number of officials including a member of the NTT DPRD from the Golkar Party, Jonas Salean who is also a former Mayor of Kupang. (rey)
