Indonesian Parliament Drafts Gig Worker Bill to Protect Ride-Hailing Drivers and Content Creators

Fajarasia.id – The Indonesian House of Representatives (DPR RI) is currently deliberating the Gig Worker Bill (RUU Pekerja GIG A22), a landmark regulation aimed at providing legal protection for workers in the digital platform economy.

The initiative, spearheaded by Syaiful Huda, legislator from the National Awakening Party (PKB) and Deputy Chairman of Commission V, seeks to safeguard gig workers such as ride-hailing drivers, food couriers, YouTubers, content writers, and freelance creatives who have long been vulnerable in their relationships with platform companies.

“This bill is designed to fill the legal vacuum. Gig workers must receive protection equal to formal employees, without losing the flexibility that defines this sector,” Huda stated in Jakarta on Monday.

What the Bill Covers
The draft legislation, consisting of 105 articles, focuses on three key areas:

Guaranteeing basic rights for gig workers while maintaining flexibility.

Ensuring minimum compensation and access to social security.

Enhancing professionalism and integrity to safeguard public safety.

In addition, the bill requires digital platforms to be transparent in their use of algorithms, uphold procedural fairness, and share responsibility for social and operational risks.

Impact on Workers and Platforms
The proposed law is expected to provide income certainty for app-based drivers, with minimum earnings calculated to account for operational costs and inflation. It also offers procedural protection against unilateral termination of partnerships.

For platform companies, the regulation would fundamentally reshape cost structures and risk management. Tariffs will be determined through a consultative mechanism within a newly established Consultation Council.

Building a Healthy Gig Ecosystem
Huda emphasized that the drafting of RUU Pekerja GIG A22 requires cross-party support and collaboration with the Legislative Body and DPR leadership.

“The main goal is not to serve specific groups, but to build a healthy gig worker ecosystem—protecting workers while providing certainty for employers,” he concluded.

If passed, the Gig Worker Bill would mark a significant step in Indonesia’s efforts to regulate the fast-growing digital labor market, ensuring fairness and sustainability for millions of gig workers nationwide.****
