Tomorrow! The Constitutional Court read out the verdict on interfaith marriage lawsuits

Fajarasia.id – The Constitutional Court (MK) will hold a decision hearing on the substantive test on interreligious marriage. The reading of the decision is scheduled for tomorrow, Tuesday, January 31, 2023.

“Substantial revision of Law No. 1 of 1974 on Marriage, as amended by Law No. 16 of 2019 on Amending Law No. 1 of 1974 on Marriage,” the negotiation plan was quoted on Monday (30.1.) 2023).

As is known, the case was filed by E. Ramos Petesi, a Catholic who had failed to marry a Muslim woman. The issue of interfaith marriages in Indonesia has also received attention, prompting Kamaruddin Amin, Director General of Islamic Community Leadership (Dirjen) of the Ministry of Religious Affairs (Kemenag), to speak up.

According to Kamaruddin, courts generally do not legalize the existence of interreligious marriages. However, the court ordered Dukcapil to record the marriage under his Law No. 23 of 2006 on Population Control.

Kamaruddin said Indonesia’s marriage law is currently being contested in the Constitutional Court (MK). Plaintiffs are of the opinion that the Marriage Act does not take interfaith marriages into account. “Our Marriage Law does not allow for inter-religious marriages, nor does the MUI Fatwa. “We don’t take into account people who marry between different religions when we compose the law.” ***
